Terms of Service

1. Acceptance of Terms & Scope

By booking a project sprint, approving a fixed-scope project proposal, or submitting a deposit with Nafeesa Ali | Digital Growth Studio, you agree to be bound by these Terms of Service.

These terms represent the entire agreement between the Client and Nafeesa Ali regarding custom web engineering, speed optimization, and AI automation consulting.

2. Service Tiers & Turnaround Timelines

We deliver specialized, founder-engineered solutions across three structured tiers:

• Starter Launch Package (10–14 Days): Up to 5 bespoke custom responsive pages, sub-2s speed optimization, technical SEO foundation, mobile-first UX, and click-to-WhatsApp conversion buttons.
• Growth & Conversion Upgrade (2–3 Weeks): Up to 15 custom pages, bilingual English/Arabic RTL typography, 24/7 custom AI Chatbot trained on your business data, instant WhatsApp routing, and Schema.org rich snippets.
• Scale Ecosystem Platform (3–4 Weeks): Custom e-commerce portals, booking platforms, custom API integrations, multi-currency checkout, and advanced client workflows.

3. 50/50 Milestone Payments & Refund Policy

To eliminate client financial risk and guarantee mutual accountability, engagements operate on a structured milestone schedule backed by our 14-day satisfaction policy:

• Initial Deposit (50%): Paid upon project kickoff to reserve development calendar bandwidth, initiate business model analysis, and engineer UX wireframes. Fully refundable if cancelled before wireframe milestone sign-off.
• Final Milestone (50%): Invoiced only after the staging site is fully constructed, tested on real devices, and formally approved by you prior to live DNS propagation.
• 14-Day Post-Launch Satisfaction Guarantee: If the delivered platform fails to match the approved staging specifications within 14 days of launch, our engineering team will rectify all issues immediately or issue a pro-rata refund in accordance with our detailed Refund Policy.
• Currency & Taxes: Quotes are issued in UAE Dirhams (AED) or US Dollars ($ USD) with zero hidden maintenance charges.

4. Code & Intellectual Property Ownership

Full Client Assignment: Upon receipt of final payment, all custom code, HTML/CSS/JavaScript assets, Figma visual mockups, graphics, and database configurations created specifically for your project become your 100% exclusive intellectual property.

Portfolio Showcase: Unless an explicit Non-Disclosure Agreement (NDA) specifies otherwise, Nafeesa Ali reserves the standard right to showcase screenshots, case study metrics, and non-sensitive performance benchmarks in our portfolio.

5. Revisions & Milestone Feedback

Each sprint includes structured review cycles at designated checkpoints (Wireframe Review, Visual Design Polish, Staging Functional QA).

To maintain our fast 14–21 day turnaround schedules, clients agree to provide consolidated feedback within two (2) business days of each milestone preview. Substantial new feature requests outside the initial scope document will be estimated transparently as add-ons.

6. Complimentary 30-Day Post-Launch Warranty

Every custom website includes a complimentary 30-day post-launch warranty period.

During these 30 days, any bugs, CSS display anomalies, mobile responsiveness defects, or broken form submissions are resolved immediately at zero additional cost with direct priority WhatsApp support.

7. Confidentiality & Non-Disclosure Standards

We treat all proprietary operational data, customer lists, profit margins, unreleased product roadmaps, and private business communications shared during the sprint with utmost discretion.

We are glad to execute mutual Non-Disclosure Agreements (NDAs) prior to receiving proprietary company documents or enterprise database credentials.

8. Warranties & Limitation of Liability

We guarantee that our web platforms meet modern standards, load in sub-2 seconds under standard testing parameters, and pass Core Web Vitals audits.

We do not make arbitrary guarantees regarding third-party search engine algorithm rankings or exact sales numbers, as commercial outcomes depend on broader market forces. To the maximum extent permitted by UAE law, our total aggregate liability under any sprint shall not exceed the actual fees paid by the client for that specific engagement.

9. Governing Law & Dispute Protocol

These terms shall be governed by and construed in accordance with the commercial laws of the Emirate of Dubai and the United Arab Emirates.
